Muffin Break National Loyalty Program – the “Muffin Break Rewards”

1 Purpose

The following terms and conditions govern the operation of the Muffin Break Loyalty Program owned and operated by Muffin Break in Australia which is known as “Muffin Break Rewards” (the Loyalty Program). This document details the various benefits and other rewards available to members, the earning or accruing entitlements under the program, the means of using or accessing such benefits and rewards and other general conditions.

2 Terminology

2.1 In these terms and conditions:

Casual Member means a person who has been issued a Rewards Card by Muffin Break but has not registered the Rewards Card via the Member Portal;

Loyalty Program means the Muffin Break Loyalty Program owned and operated by Muffin Break in Australia and known as “Muffin Break Rewards”.

Muffin Break App means the Muffin Break app developed for use by customers of Muffin Break stores in Australia;

Muffin Break App Installation Requirements means the requirements to properly download and activate the Muffin Break App (as updated from time to time), including without limitation details of:

  • (a) the person’s date of birth (the person must be over 13 years of age); and
  • (b) either:
    • (if the person does not hold a Rewards Card) enter the person’s unique email address to register; or
    • (if the person already holds a Rewards Card or Member account): enter the required details of the Rewards Card or Member account; and
  • (c) If not already registered, the person must nominate a password to enable access to their Member Account.

Member means and includes, in relation to the Loyalty Program, each of the following:

  • (a) a Casual Member;
  • (b) a Registered Member;

Member Account means the account information specific to a Member, other than a Casual Member, which is password protected and accessible by the Member through the Member Portal.

Member Portal means, in relation to the Member Account, the following: https://members.muffinbreak.com.au/

Muffin Break means Muffin Break Pty Ltd ACN 007 192 529.

Privacy Policy means Muffin Break’s privacy policy (/privacy-policy/) as may be updated from time to time.

Registered Member means a person who has registered a Member Account via the Member Portal in accordance with the Registration Requirements, or registered via the Muffin Break App in accordance with the Muffin Break App Installation Requirements at the relevant time.

Registration Requirements means the requirements to properly register a Rewards Card as specified on the Member Portal (as updated from time to time), including without limitation details of:

  • (a) the unique card number and verification code of the Rewards Card;
  • (b) the person’s date of birth (the person must be over 13 years of age);
  • (c) the person’s unique email address;
  • (d) the person must nominate a password to enable access to their Member Account after completing registration.

Rewards Card means the loyalty card, bearing a unique card number and verification code, provided by Muffin Break for use by a person in relation to the Loyalty Program, and includes both:

  • (a) the physical loyalty card issued to a person; and
  • (b) a virtual or electronic copy of this loyalty card.

Scan means, for the purpose of a Member earning or accruing rewards or benefits under the Loyalty Program by a purchase transaction from a Store, either:

  • (a) scan the barcode of a Rewards Card or an electronic copy of the Rewards Card at the in-Store barcode reader; or
  • (b) QR code (app) can be presented in Store and scanned by the in-Store equipment

Small Hot Beverage means a small hot coffee or other hot beverage available at the relevant Store.

Store means a Muffin Break store in Australia, excluding Muffin Break Express.

2.2 In these terms and conditions:

  • (a) where any word or phrase is given a particular meaning, other grammatical forms of that word or phrase have corresponding meanings; and
  • (b) a reference to a person includes a body corporate or other entity.

3 Membership Procedures

3.1 A Casual Member:

  • (a) must be issued with a Rewards Card by a Store;
  • (b) must scan the Rewards Card in order to accumulate points for the relevant purchase in Store

3.2 Becoming a Registered Member means registering via the Member Portal in accordance with the Registration Requirements, or Muffin Break App in accordance with the Muffin Break App Installation Requirements at the relevant time.

4 Casual Member – Loyalty Program Rewards

4.1 To participate in in the Loyalty Program, a Casual Member must scan the Rewards Card in order to accumulate points for the relevant purchase in Store.

4.2 A Casual Member will accrue one (1) point in the Loyalty Program for every hot beverage purchased at a Store, which points will be credited to the Casual Member’s Rewards Card account.

4.3 After accumulating four (4) points in the Loyalty Program:

  • (a) the points balance on the Casual Member’s Rewards Card account will revert to zero; and
  • (b) subject to paragraph (c), the Casual Member will be eligible to receive a free Small Hot Beverage; and
  • (c) the free Small Hot Beverage credited to the Casual Member’s Rewards Card account is valid for ninety (90) days after it is credited to the Casual Member’s Rewards Card account. If the free Small Hot Beverage is not redeemed within that time, the reward will become inactive without notice.

4.4 A Casual Member will only be entitled to the benefits or rewards available to a Registered Member unless and until the Casual Member becomes a Registered Member by completing registration in accordance with the Registration Requirements, or Muffin Break App Installation Requirements.

5 Registered Member – Loyalty Program Rewards

5.1 A Registered Member:

  • (a) must present and Scan the Rewards Card in order to accumulate points for the relevant purchase in Store; and
  • (b) will accrue one (1) point in the Loyalty Program for every hot beverage purchased at a Store, which points will be credited to the Member Account for that Member;

5.2 After a Registered Member accumulates four (4) points in the Loyalty Program to their Member Account:

  • (a) the points balance on the Member Account will revert to zero; and
  • (b) subject to paragraph (c), the Registered Member will be eligible to receive a free Small Hot Beverage; and
  • (c) the free Small Hot Beverage credited to the Member Account will be valid for ninety (90) days after it is credited to the Member Account. If the free Small Hot Beverage is not redeemed within that time, the reward will become inactive without notice.

5.3 A Registered Member will be eligible to receive a free birthday muffin as a “Birthday Gift” for the Member’s birthday each year. The free birthday muffin:

  • (a) will be valid for one (1) month for the Member’s registered birthday calendar month; and
  • (b) may only be redeemed by the Member by presenting and Scanning their Rewards Card at a Store; and
  • (c) if the free birthday muffin is not redeemed by the Member within that time, the reward will become inactive without notice.

6 General Conditions

6.1 Each Member acknowledges and agrees that:

  • (a) the terms of the Privacy Policy are incorporated in these terms and conditions; and
  • (b) by participating or engaging in the Loyalty Program, the Member has read, understands and accepts the terms of the Privacy Policy, including (without limitation) Muffin Break’s rights and entitlements in relation to the collection, use and disclosure of personal information.

6.2 A Member will not earn or accrue any points for any products supplied by a Store to the Member for no charge.

6.3 A Member may only earn or accrue points from purchase transactions by a Member in a Store. Any products purchased by a Member on the Muffin Break online store will not be included in to the Loyalty Program and will not accumulate any points.

6.4 Any reward or benefit available to a Member under the Loyalty Program may not redeemed or exchanged for other items available for purchase from a Store or for money.

6.5 Any reward or benefit available to the Member will not be extended under any external circumstance, including but not limited to public holidays, café closures, lockdowns, etc.

6.6 A Member may redeem as many valid and accumulated Loyalty Program rewards and benefits in a single transaction.

6.7 Members are entitled to receive any special offers available to all Muffin Break customers in Australia from time to time.

6.8 A Member may not use or enjoy any other Muffin Break promotional offer in conjunction with any reward or benefit available to the Member under the Loyalty Program.

6.9 While every endeavour will be made in store to ensure Loyalty points are correctly awarded, Muffin Break takes no responsibility for technical errors associated with crediting points onto the Member account.

6.10 Muffin Break reserves the right to:

  • (a) amend or vary these terms and conditions at any time, including without limitation:
    • to vary the rewards and benefits available to Members;
    • to cease provision of particular rewards and/or benefits to any Members;
    • to vary the method of redemption of rewards and benefits available to Members;
    • to vary the period within which rewards and benefits are able to be redeemed by Members.
  • (b) not accept any Loyalty Club membership that it believes to be unauthorised, fraudulent or unlawful;
  • (c) request information or identification from a Member confirming their Membership in the Loyalty Program; and
  • (d) merge Member Accounts should two or more be registered to the same email address.
