Notification of Winners 20 winners will be randomly selected on 20th May 2025, and notified via the telephone or mobile number provided upon registration to the Muffin Break loyalty program, Muffin Mates. A back-up draw of 10 extra winners would be carried in case the original winners are unable to be contacted.   The random draw will be conducted using a computerised random number generator that assigns each valid entry a unique number, ensuring a fair and unbiased selection process.     No additional information is required to claim the prize. Winners must respond by 8th June 2025, or the prize will be forfeited.  Winners first name initial, full surname and the winner’s state/territory will be announced on the Promoters website https://muffinbreak.com.au/muffin-break-promotion-winners/..  Muffin  Break loyalty will reach out to winners by a phone call, subsequently sending an email of the electronic tickets to them if they are successfully contacted.

TERMS & CONDITIONS

  1. Information on how to enter and the prizes form part of these Terms and Conditions.  
  1. The Terms and Conditions must be read in conjunction with the Schedule. The Schedule defines the terminology used in these Terms and Conditions of entry. Where there is any inconsistency between these Terms and Conditions and the Schedule, the Schedule prevails. Participation in this Promotion is deemed acceptance of these Terms and Conditions. 
  1. The Promoter is Muffin Break Pty Ltd ACN 007 192 529 of Building 208-1M, The Entertainment Quarter, 122 Lang Road, Moore Park, NSW 2021 | PO Box 303 Double Bay NSW 1360. Website: www.muffinbreak.com.au (Promotion Website). 
  1. The Promotion commences at 12:00am AEST on 3 May 2025 and closes at 11:59pm AEST on 13 May 2025 (Promotion Period). No entries outside of the Promotion Period will be accepted. The time of entry is the time that an entry is received by the Promoter. 
  1. Entry is open to all Australian citizens and permanent residents (Australian Residents) aged 18 years and over at the commencement of the Promotion Period who remain Australian Residents for the duration of the Promotion Period, except for the following persons who are not eligible to enter: 

(a) directors, officers and employees (and their Immediate Family Members) of the Promoter, of the Promoter’s related entities, of the Promoter’s distributors or suppliers, or of agencies associated with the Promotion; Immediate Family Members means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin; 

(b)       persons assisting with the Promotion (and their Immediate Family Members); 

(c) the Promoter’s franchisees (and their Immediate Family Members); and 

(d) directors, officers, employees (and their Immediate Family Members) of the   Promoter’s franchisees. 

  1. Method of Entry 

To enter the Promotion, the entrants must: 

  1.     during the Promotion Period: 

Either: 

  1. Make a total purchase of $15 or more at a Muffin Break store; and 
  1. Scan their Muffin Break Muffin Mates digital loyalty card.  

                OR 

 (i)    Make a total purchase of $15 or more at a Muffin Break store via the Muffin Break   Muffin Mates app 

(collectively, Eligible Purchase); and 

(b) before the end of the Promotion Period: 

(i) have registered as a Muffin Break member; and 

(c) remain Registered at the end of the Promotion Period. 

  1. Entrants will automatically be entered into the Promotion once steps (a) and (b) above are completed, provided that entrants are Registered at the time of making an Eligible Purchase or become Registered after making an Eligible Purchase 
  1. The Promotion will be conducted during the Promotion Period. The time zone applicable to any time stated relates to the state or territory where the Promoter is located, unless expressly stated to the contrary.  
  1. The Prize/s are specified in the Prize Details section of the Schedule. The total prize pool is specified in the Total Prize Value section of the Schedule. Any prize is valued in Australian dollars unless expressly stated to the contrary. 
  1. Entrants are responsible for any and all expenses that they incur in entering the competition and they will not be reimbursed regardless of whether or not they win the competition. 
  1. The entrants must follow the Method of Entry during the Promotion Period to enter the Promotion. Failure to do so will result in an invalid entry. The Promoter will not advise an entrant if their entry is deemed invalid. The time of entry will be deemed to be the time the entry is received by the Promoter. 
  1. Entrants can submit unlimited entries to the draw. 
  1. The Promotion is a game of chance, and the winner of the Prize will be determined by a random draw of all valid entries. All valid entries must be received by the Promoter during the Promotion Period. 
  1. The random draw to determine the winner of the Prize will take place at 1 pm] AEST on Tuesday 20 May 2025 at the Promoter’s office at Building 208-1M, The Entertainment Quarter, 122 Lang Road, Moore Park, NSW 2021. 
  1. The Promoter will draw additional 10 reserve entries and record them in order. In the event that an invalid entry or ineligible entrant is drawn then the Prize will be awarded to the first reserve entry drawn in respect to that separate entry pool. The Promoter will continue this process until the Prize is awarded. 
  1. The prize is “Win movie pass Giveaway” in the form of 2 electronic movie tickets sent to the winner’s email address registered on the Muffin Mates. The value of each Prize is around $40 (including GST) and is not redeemable for cash or any other offer.  
  1. The Promoter accepts no responsibility for any late, lost, delayed, incomplete, incorrectly submitted, corrupted, illegible or misdirected entries, claims or correspondence whether due to omission, error, alteration, tampering, deletion, theft, destruction, disruption to any communication network or medium, or otherwise including those entries not received by the Promoter for any reason. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. No correspondence will be entered into. 
  1. The winner(s) will be notified in accordance with the Notification of Winners sections of the Schedule. Notification to winners will be deemed to have occurred later of the time the winner receives actual notification from the Promoter or two business days thereafter. The notification will include details about how the prize(s) can be claimed 
  1. The Promoter takes no responsibility where it is unable to contact prize winners who have not provided correct or complete contact details. If an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to modify any entry information should be directed to the Promoter. Please email customerservice@muffinbreak.com.au  to notify of any change in details. 
  1. It is a condition of accepting any prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. 
  1. To the greatest extent permitted by law, the Promoter excludes all warranties, representations or guarantees (Warranties) regarding the Promotion and any prizes, including any Warranties which may have been made in the course of advertising or promoting the Promotion. The conduct of the Promotion or the supply of prizes may involve third parties, and the Promoter makes no Warranties and disclaims all liability in connection with any such third parties, their acts or omissions. By entering the Promotion, an entrant releases and indemnifies the Promoter and its related bodies corporate (including the officers, employees and agents of each) from and against all actions, penalties, liabilities, claims or demands the entrant may have against the Promoter or that the Promoter may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an entrant entering or participating in the Promotion or winning or failing to win a prize, or using or permitting any other person to use the prize, except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable. 
  1. Prizes, or any unused portion of a prize, are non-transferable and/or not exchangeable and/or cannot be taken as cash, subject to any written directions from a regulatory authority. Where a prize is unavailable for any reason, the Promoter may substitute the prize for another item of equal or higher value subject to any written directions from a regulatory authority. The Promoter accepts no responsibility for any variation in prize value (including between advertising of the Promotion and receipt of the prize). 
  1. Entrants consent to the Promoter using the personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes, including to third parties involved in the promotion and any relevant authorities. 
  1. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such personal information to third parties. Entry into the Promotion and acceptance of the Prize or any part of it is conditional on providing this personal information. In addition to any use that may be outlined in the Promoter’s privacy policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning an entrant or winner.   1. The Promotion and these Terms and Conditions will be governed by the law of the State or Territory in which the Promoter ordinarily resides. Entrants accept the non-exclusive jurisdiction of courts and tribunals of that State or Territory in connection with disputes concerning the Promotion.
