Instant Win Terms |
Winners will be notified immediately of the prize they have won by the display of the applicable instant win prize after scratching the scratch card. Every eligible entrant will win a prize and winners of the type of instant prize are determined by chance. |

Prize Redemption |
To redeem a prize, winners must:
Prize can only be redeemed once and must be redeemed at least 10 days after receiving the prize. The voucher received by the prize winner will contain a countdown timer, displaying the time remaining for the prize winner to redeem the Prize before it expires. |

TERMS AND CONDITIONS
- Information on how to enter and the prizes form part of these Terms and Conditions. The entrant agrees and acknowledges that they have read these Terms and Conditions (including the Schedule) and that entry in this Promotion is deemed acceptance of these Terms and Conditions (including the Schedule). Any capitalised terms used have the meaning given in the Terms and Conditions or Schedule, unless stated otherwise.
Eligibility
- Entry is open to all Australian residents who live in NSW, VIC, QLD, NT, SA, WA, TAS aged 18 years and over as at the Start Date of the Promotion. Residents in any other states or territories are not eligible tobenter the Promotion.
- The following are ineligible to participate in the Promotion: (i) directors, officers and employees (and their immediate families) of the Promoter or its related entities or of a Muffin Break franchisee; (ii) directors, officers and employees (and their immediate families) of any Muffin Break franchisee; or (iii) the Promoter’s suppliers and agencies associated with the Promotion. Immediate family means any of the following: spouse, ex-spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
- In entering the Promotion, the entrant warrants that they are the owner of the email account used to enter the Promotion.
Promotion Period
- The Promotion commences on the Start Date and ends on the End Date. Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter and its agencies are final and conclusive as to the time of receipt
- Valid and eligible entries will be accepted during the Promotional Period. All entries become the property of the Promoter.
Prizes
- Each prize will be awarded to the person named in the entry (by virtue of being the owner of the email address used to enter the Promotion) and any entry that is made on behalf of an entrant or by a third party will be invalid. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner
- Each Prize will display the date by which the Prize must be redeemed before it expires.
- If any winner chooses not to take their Prize (or is unable to), loses their Prize or does not take or claim a prize by the time specified by the Promoter (as displayed on the Prize voucher), they forfeit the Prize, and the Promoter is not obliged to substitute the prize.
- The value of the Prize is accurate and based upon the recommended retail value of the Prize (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the Prize after that date.
- No part of a Prize is exchangeable for other goods, subject to substitutions, redeemable for cash or any other prize or transferable. If a Prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the Prize (or that portion of the Prize) to a prize of equal or greater value and specification.
Conduct of Promotion
- The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
- The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms and Conditions. If there is a dispute concerning the conduct of the Promotion or claiming a prize, the Promoter will resolve the dispute in direct consultation with the entrant. If the dispute cannot be resolved the Promoter’s decision will be final.
- If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in their sole discretion, to the fullest extent permitted by law to disqualify any entrant or modify, suspend, terminate or cancel the Promotion, as appropriate.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and/or place of residence or IP address used) and reserves the right, in its sole discretion, to disqualify any entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful, improper or inappropriate conduct. Errors and omissions may be accepted at the Promoter’s discretion.
- Incomplete, indecipherable, incorrect and illegible entries will, at the Promoter’s discretion, be deemed invalid and not eligible to win. The Promoter accepts no responsibility for any late, lost, delayed, incomplete, incorrectly submitted, corrupted, illegible or misdirected entries, claims or correspondence whether due to omission, error, alteration, tampering, deletion, theft, destruction, disruption to any communication network or medium, or otherwise including those entries not received by the Promoter for any reason. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. No correspondence will be entered into.
- The Promoter and its related entities (and any franchisee of the Promoter) will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
- By entering the Promotion, an entrant releases and indemnifies the Promoter and its related bodies corporate (including the officers, employees of each) from and against all actions, penalties, liabilities, claims or demands the entrant may have against the Promoter or that the Promoter may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an entrant entering or participating in the Promotion or winning or failing to win a prize, or using or permitting any other person to claim or use a prize, except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable.
Use of Personal Information
- In entering the Promotion, entrants consent to the Promoter using the personal information provided and collected in connection with this Promotion for the purposes of facilitating the conduct of the Promotion and awarding any prizes, including to third parties involved in the promotion and any relevant authorities. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically where consent by the entrant has been obtained. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion.
- The Promoter’s Privacy Policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of any privacy laws and how such complaints will be dealt with.
General
- Facebook or Instagram may be used to advertise or promote the Promotion. By entering the Promotion, entrants agree that the Promotion is in no way sponsored, endorsed or administered by, or associated with any such social media platform; and to release such social media platforms from all liability in relation to this Promotion. Any questions, comments or complaints regarding the Promotion should be directed to the Promoter and the relevant social media platform.
- Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Australian Consumer Law.
- The Promotion and these Terms and Conditions will be governed by the law of New South Wales. Entrants accept the non-exclusive jurisdiction of courts and tribunals of New South Wales in connection with disputes concerning the Promotion.
