Trolls World Tour Colouring In Competition Terms & Conditions

  1. Information on how to enter and the Prize form part of these Terms and Conditions. Participation in this Competition and acceptance of the Prize is deemed acceptance of these Terms and Conditions.
  2. The Promoter is Muffin Break Pty Ltd (ACN 007 192 529) of Unit 215F1, Building 215, The Entertainment Quarter, 122 Lang Road, Moore Park NSW 2021 | PO Box 303 Double Bay NSW 1360 (Website: muffinbreak.com.au).
  3. Entry is open to all Australian residents. Directors, officers and employees (and their immediate families) of the Promoter and of agencies associated with the Competition are ineligible to enter.
  4. All entrants under 18 years of age must have prior consent from their parent or guardian before entering into the Competition. If the winner is under 18 years of age, the Prize will be awarded to the winner’s nominated parent/guardian. The parent/guardian shall be deemed the winner for the purposes of these Terms and Conditions.
  5. To enter the Competition, entrants must during the Competition Period:
    1. purchase a Mighty Mini Meal from any participating Muffin Break store listed in Schedule 1 of these Terms and Conditions (Participating Muffin Break Store) and receive a Trolls Colouring Sheet entry form (Entry Form);
    2. colour in and fill in the Entrant’s name and contact number on the Entry Form; and
    3. return the completed Entry Form to a Participating Muffin Break Store by 5.00pm (AEST) on Sunday 31 January 2021.
  6. The Competition starts at 9.00am (AEST) on Monday 4 January 2021 and ends at 5.00pm (AEST) on Sunday 31 January 2021 (Competition Period). No entries received outside of the Competition Period will be accepted. The time of entry is the time that an entry is received by the Promoter.
  7. Multiple entries are permitted and there will only be one winner per Participating Muffin Break Store. The Competition is a game of skill. Chance plays no part in determining the winner. All entries will be individually judged based on creativity. The best entry from each Participating Muffin Break Store as determined by the Promoter will win the Prize.
  8. Judging will take place at the participating Muffin Break store on Sunday 7 February 2021. The judges may select additional reserve entries, which they determine to be the next best, and record them in order, in case of an invalid entry, ineligible entrant or winner not claiming the Prize by the specified time. Incomplete or illegible entries will be deemed invalid.
  9. The winner will be notified via telephone by 5.00pm (AEST) on Sunday 7 February 2021. The winner will need to collect the Prize from the Participating Muffin Break Store by 5.00pm (AEST) on Saturday 21 February 2021. If the winner does not claim the Prize by such time. The winner will be deemed to have forfeited the Prize and the next runner up will be notified via telephone by 5.00pm (AEST) on Monday 22 February 2021. The runner up will need to collect the Prize from the Participating Muffin Break Store by 5.00pm (AEST) on Monday 8 March 2021. If the runner up does not claim the Prize by such time the Prize will be forfeited.
  10. The Promoter’s decision in connection with all aspects of the Competition is final and no correspondence will be entered into.
  11. Incomplete or illegible entries will be deemed invalid.
  12. Each winner from each Participating Muffin Break Store will receive One (1) Trolls World Tour DVD which has an estimated value of AU$20.00 (Prize).
  13. The Prize cannot be transferred to a different person, exchanged for other goods and/or services or redeemed for cash. If the Prize is unavailable, the Promoter in their discretion reserves the right to substitute the Prize with goods and/or services of equal value.
  14. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  15. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and/or place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  16. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  17. As a condition of entering this promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
  18. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in their sole discretion, to the fullest extent permitted by law to disqualify any entrant; or modify, suspend, terminate or cancel the Competition, as appropriate.
  19. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).
  20. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees (in which case that liability is limited to the greatest extent allowed by the law), the Promoter and any agencies associated with the Competition (including their respective directors, officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of or relating to:
    1. the Competition;
    2. any technical difficulties or equipment malfunction;
    3. any theft, unauthorised access or third party interference;
    4. any entry or Prize claim that is late, lost, altered, damaged or misdirected;
    5. any variation in Prize value to that stated in these Terms and Conditions;
    6. the delay, postponement or cancellation of any activity;
    7. any tax liability incurred by a winner or entrant; or
    8. the Prize or any part of the Prize, including, providing, delivering, accepting, taking, participating in or using the Prize or any part of the Prize.
  21. As a condition of accepting a prize, the winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  22. The Promoter collects personal information (PI) in order to conduct the Competition and may, for this purpose, disclose such PI to third parties. Entry into the Competition is conditional on providing this PI. The Promoter will also use and handle PI as set out in their Privacy Policy, which can be viewed at /privacy-policy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
  23. Any costs associated with entering the Competition are the responsibility of the entrant.
